Best Append Terms of Service Agreement
By engaging with Best Append for products and services, you acknowledge and agree to the following terms outlined in this Service Agreement:
Product Purchase and List Integrity
Upon acquiring an email database list from Best Append, you will receive an email with download instructions within 3-4 business days following your purchase. While we ensure that all email addresses were valid at the time of their collection, we cannot guarantee their current validity or accuracy. Our lists are compiled over time from various sources, including co-registration services, online surveys, and third-party data contributors. Some addresses may originate from agreements with vendors who promote home business opportunities. The accuracy of leads, including deliverability, contact information, and details, cannot be guaranteed. As such, Best Append does not promise specific outcomes from the use of any list. All sales are final, with no refunds offered. In cases of inaccuracies, Best Append may provide additional leads as compensation. The responsibility for the use and deliverability of data post-purchase lies solely with the purchaser.
Financial Terms and Refund Policy
You confirm that all financial information provided to Best Append, including but not limited to credit card and electronic debit details, is accurate and lawfully yours. You acknowledge our no-refund policy. Chargebacks, payment reversals, or any actions leading to the theft of services will be pursued legally. You are responsible for all charges incurred due to fraudulent financial activity.
Default and Breach
Failure to fulfill payment obligations or breaching any terms of this agreement requires you to compensate Best Append for any resultant damages. This includes direct, indirect, incidental, or economic losses, alongside reasonable legal fees and costs associated with enforcing this agreement.
Additional Terms
- Children’s Privacy: Best Append does not knowingly collect information from children under 18. Any such information will be promptly deleted upon discovery.
- Right to Refuse: Best Append reserves the right to refuse service in alignment with ethical marketing practices.
- Limitations of Liability: Best Append disclaims all warranties beyond those explicitly outlined in this agreement, providing services and products “as is.”
- Indemnification: You agree to indemnify Best Append against liabilities arising from your use of our services.
- Modification of Terms: Best Append reserves the right to modify these terms, with continued use of services constituting agreement to such changes.
- Entire Agreement: This document represents the full agreement between Best Append and the client, superseding all prior discussions and agreements.
Legal Compliance and Database Use
You agree to use our data in compliance with all applicable laws, including but not limited to the CAN-SPAM Act of 2003 and telemarketing regulations. Best Append must not be represented in any unauthorized marketing materials. The licensee is solely responsible for the legal compliance of their marketing activities.
Refund Policy for Database Information
All sales are final. Best Append is not responsible for the misuse of information post-sale. Compliance with the CAN-SPAM Act of 2003 is the purchaser’s responsibility.
